Are potentially polygamous marriages recognised in Australia?
In Ghazel and Anor [2016] FamCAFC 31 (4 March 2016) the Full Court heard
a wife's appeal against the decision to dismiss her application to have
her marriage declared valid. The Full Court determined that, whilst
her Iran marriage could become a potentially polygamous marriage due to
the marriage laws in Iran, the Marriage Act had no provision which
excluded recognition of her marriage. As such, the Court determined
that a potentially polygamous marriage (i.e as in Iran a man could take
up to 3 other wives) was not at odds with the Australian Marriage Act.
