Backpackers to Australia (European,Scandinavian,American,Canadian)

What support legally is their for Backpackers who come to this country (Australia) to have a holiday and work for their visa if they encounter problems? These are usually very young adults often traveling alone and a prepared to work for an honest days pay in reasonable conditions? enviroments and that their safety will not be at risk.I am an Admin for a Facebook Page for Australian Backpackers and am seeing the continual stream of questions where can they get help.Of course they are on a tight budget so legal help seems out of the question always .Most of them end up feeling powerless and simply move on not having the resources to find justice. My question? Where do i direct them for advice?

Hi there. As they are working in Australia they are covered by the same workplace laws and have access to the similar government bodies that protect workers. For example, Fair Work Australia has a series of fact sheets as well as an information line that may help. The relevant fact sheet for backpackers is here:http://www.fairwork.gov.au/about-us/policies-and-guides/fact-sheets/rights-and-obligations/visa-holders-and-migrant-workers-workplace-rights-and-entitlements

They could also visit a community legal centre in their area and they might be able to assist. It will depend on the resources available to the centre, but it can be a great place to get a referral to someone else in the area that can help. Most community legal centres have websites that have their contact details and opening hours.

They can, of course, use LawAdvisor right now to ask a basic legal question for free. It's a great way of getting some basic legal information to help them figure out what to do.

When the jobs feature opens in the next few months, they will be able to search for experienced lawyers and obtain fee proposals for their services. Costs for legal advice and representation will vary between providers based on experience and the scope of services. They can use LawAdvisor to find a lawyer who’s expertise and credentials you will be able to assess, and take on if you wish.
