I am in a dispute with the builder who is doing the fit out of the new caf‚ for my business. The builder wants to resolve the dispute via informal negotiations, despite the building contract saying all disputes are to be resolved via arbitration. Can I force the matter to be resolved via arbitration? Will the outcome be more enforceable than a negotiated outcome?
