Storm water discharge

I have a semi detached house. I have demolished my side and started construction of a new duplex, which was approved by council. Construction has started and we have since discovered that there is a pipe coming from my neighbour's house leaking water into mine. 

It appears to be a storm water drain, which needs to be diverted or moved. My question is whose responsibly it is to do this work. Is it mine or my neighbour's? It appears this old pipe was running through my property before construction commenced.
