Withholding pay

I left my site of work after a confrontation with supervisor to prevent things going further. Verbal threats were made.

I walked back to Adelaide. I arrived sick so I informed them and got a certificate. Handed my time sheet in to be payed the Monday only and was told I have been stood down without pay until further notice. I have sick leave and work full time.

Is it legal to withhold my pay and how long can they do this? Does it count as breach of contract? What can i do to get paid?

Good afternoon.

There are certain remedies available to workers who are unfairly dismissed or who believe their entitlements have been unfairly dealt with.Further details are needed before a complete answer can be provided.

For example:

1. what was the nature of your working relationship (e.g employee, contractor ect.),

2. was there an employment contract?

3. were they any prior written or verbal warnings logged against you?

4. have you received a formal letter of termination or similar?

Kind Regards,

Arrange a meeting with a solicitor to obtain full particulars so that they may advise whether you have any reasonable remedies available to you
